“Analysis of the generalization of judicial practice on crimes related to extremism and terrorism”

Implementation timeline:

Implemented by CAWC PA with technical support, UNDP, UNODC, UNODC, UN OHCHR, UN Women from December 10, 2018 to December 10, 2019.

Goal:

To conduct a study of judicial practice on crimes related to extremism and terrorism for the period 2014-2018 on articles 226, 226-1, 226-2, 226-3, 226-4, 226-5, 226-6, 227, 228, 229, 299-1, 299-2, 299-3, 375 of the Criminal Code of the Kyrgyz Republic) and prepare recommendations for the correct and uniform application of legal norms by the courts.

Expected results and accomplishments: 

  1. A research methodology has been developed for the study of judicial practices on extremism and terrorism-related offenses.
  2. Judicial practice data was collected in all regions of the country;
  3. Focus group discussions were conducted with direct and indirect respondents.
  4. Data on the criminal cases studied were processed and an analytical report on the study of judicial practice in cases related to extremism and terrorism was prepared.
  5. A conference was held at the Zhanat Resort Hotel with the participation of 120 people to discuss the results of a study of judicial practice on crimes related to extremism and terrorism.
  6. Recommendations on improving judicial practice in cases related to extremism and terrorism have been prepared and sent to interested government bodies.
  7. Training for trainers for judges of local courts was held on the topic: “Peculiarities of consideration by courts of cases on crimes related to extremism and terrorism”.

Newer UNDP “Strengthening Accountability in the Implementation of the Rule of Law in the Kyrgyz Republic”, Phase II A study of prosecutorial practices (supervision and prosecution) related to violence against women and GBV and reasons for low conviction rates in GBV cases, including early marriage and domestic violence, with detailed recommendations to address the gaps in the current situation of handling cases of GBV victims was implemented by the “Kyrgyz Association of Women Judges” NGO for 5 months from October 8, 2019 to March 8, 2020.

Older The European Union’s program “Supreme Law in the Kyrgyz Republic – 2nd phase” (ROLPRO- 2) to conduct trainings for lawyers and jurists on the topic: “Providing legal services on gender crimes” was implemented by the Public Association “Kyrgyz Association of Women Judges” (hereinafter – KAWJS) from August 19 to December 31, 2019 and was extended until January 31, 2020. This project was a continuation of one of the recommendations of the UNDP project “Prevention of Gender Equality against Women and Girls”.
